Terms of Service
These Terms of Service (“Terms”) govern your use of the Iran IP VPN application, website, and related services (together, the “Service”), which are operated by A and S Lomond (“we”, “us”, or “our”). The Service is sold and provided only to users located outside Iran. See Section 1. By downloading, installing, purchasing, or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility, geographic scope & sanctions compliance
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use the Service. By using it, you confirm that you meet this requirement.
The Service is offered only to users located outside Iran. It is designed for members of the Iranian community and others who live, work, or travel outside Iran and who wish to reach legitimate, lawful Iran-based websites and online services from abroad. The Service is not offered, sold, marketed, or directed to any person who is resident in or physically located inside Iran, and it is not intended for use within Iran.
By downloading, purchasing, or using the Service, you represent and warrant, each time you use it, that:
- you are not resident in, ordinarily located in, or accessing the Service from inside Iran, Cuba, North Korea, Syria, or any other territory subject to comprehensive economic sanctions;
- you are not named on, or owned or controlled by a person named on, the U.S. Treasury Office of Foreign Assets Control (OFAC) Specially Designated Nationals (SDN) list, the U.S. Denied Persons or Entity List, the EU or UK consolidated sanctions lists, or any other applicable restricted-party list;
- you are not the Government of Iran, an agency, instrumentality, or official of it, and you are not acting for or on behalf of any sanctioned government, entity, or person;
- you will not use the Service on behalf of, or to provide any benefit to, a person, government, or place described above; and
- you will use the Service only for lawful purposes and in compliance with all export-control, sanctions, and other laws that apply to you.
You are responsible for ensuring that your use of a VPN, and of the Service, is lawful in the place where you are located. If any of these statements stops being true, you must stop using the Service immediately. We may use your IP address and coarse location to assess eligibility, and we may refuse, geographically restrict, suspend, or terminate access, withhold or reverse a sale, or decline to deal with anyone, where we believe in good faith it is necessary to comply with sanctions, export-control, or other applicable laws, without liability to you. Nothing in these Terms requires either party to act in a way that would violate applicable sanctions laws.
2. Your account
You sign in with Google or Apple. You are responsible for keeping access to your sign-in account secure. Your email address is your account identifier. Your account and any subscription attached to it are personal to you and may not be transferred; see section 4.2. You may request deletion of your account at any time as described in our Privacy Policy.
3. Acceptable use
The Service is provided to protect your privacy and give you open, secure access to the internet. You agree not to use the Service to:
- break any applicable law or infringe the rights of others;
- send spam, malware, or launch attacks against networks or systems;
- attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to the Service or its infrastructure;
- access or use the Service from inside Iran or any other comprehensively sanctioned territory, or in any way that would cause you or us to breach sanctions or export-control laws;
- resell or commercially redistribute the Service without our written permission;
- share, sell, rent, lend, or otherwise make your account, sign-in, VPN configuration, or subscription available to anyone else (see section 4.2).
We may suspend or terminate access that we reasonably believe violates these Terms or harms the Service or other users.
4. Free and premium plans
The Service offers a free tier (which may show ads and include data and feature limits) and paid premium subscriptions (which remove ads and raise those limits). The limits of the free tier are described in the App and may be adjusted over time to keep the Service reliable and fair for everyone. The data allowance for premium subscriptions is set out in section 4.1.
Desktop apps. Full use of the desktop apps (Windows and macOS) requires a premium subscription. On the free tier, the desktop apps are limited and do not include the full Service; to use them without those limits, you need to buy premium.
4.1 Unlimited premium, subject to fair use
Premium is offered as unlimited, subject to fair use: there is no daily cap or per-session limit, and ordinary personal use will not come close to the fair-use allowance below. Premium is intended for one person’s personal use on their own devices. To keep the network fast and fair for all users, and to prevent fraud, abuse, and account sharing, each premium subscription includes the following fair-use data allowance for each subscription period:
- Weekly plan: 200 GB per one-week period;
- Monthly plan: 500 GB per one-month period;
- Quarterly plan: 1,200 GB per three-month period;
- Yearly plan: 3,600 GB per twelve-month period.
The following applies to the allowance:
- What counts. The allowance covers all data transferred through the Service (uploaded and downloaded) on every device using your account during the subscription period. Data use is measured by our servers.
- When it resets. The allowance starts when the subscription period starts and resets in full at each renewal. Quarterly and yearly allowances apply to the whole period and may be used at any pace within it; they are not divided into monthly amounts.
- No carry-over. Unused allowance does not roll over to a later period, cannot be transferred, and has no cash value.
- Reaching the allowance. If you use your full allowance before the period ends, we may suspend or reduce the speed of your premium data access until your next renewal or until you buy a new subscription. Reaching the allowance is not a breach of these Terms, and the rest of your subscription is unaffected.
- Questions about usage. If you believe a usage figure is wrong, contact us at the address in section 14 and we will review it in good faith.
- Changes. We may change these allowances under section 13. We will not reduce the allowance of a subscription period you have already paid for; any reduction applies only from a renewal that takes place after we have given you notice.
Where our website, App, or store listings describe premium as “unlimited” or as offering more data, those descriptions are subject to the fair-use allowance in this section 4.1.
4.2 Personal use; no account sharing
Your premium subscription is a personal, non-transferable licence for your own use. You may use it on your own devices, but you must not share your sign-in credentials, VPN configuration, or subscription link with anyone else, or sell, rent, lend, or resell access to your subscription.
To detect sharing, fraud, and abuse, we may consider technical signals such as data volume, the number of simultaneous connections, and connection patterns, as described in our Privacy Policy. We do not inspect the content of your traffic or the sites you visit for this purpose. If we reasonably believe an account is being shared or misused, or has been bought with a fraudulent payment, we may limit, suspend, or terminate it. Where practicable, we will tell you first and give you a reasonable opportunity to respond. If we terminate a subscription for a material breach of this section, we are not required to refund the unused part of the subscription period, except where applicable law requires it.
5. Subscriptions, billing & renewal
Premium subscriptions are sold through the Apple App Store, Google Play, the Microsoft Store, or our website billing partner (RevenueCat), depending on where you buy. By purchasing, you authorize the relevant store or processor to charge the applicable price plus any taxes.
- Auto-renewal. Subscriptions renew automatically for the same period at the then-current price until cancelled.
- Cancellation. You can cancel any time; you keep premium until the end of the current paid period. Cancel an app-store subscription in that store; manage a website purchase from your account page or via support.
- Refunds. Refunds are handled by the store or processor that took the payment, under their policies and applicable law.
6. Service availability
We work to keep the Service fast and available, but we provide it “as is” and do not guarantee uninterrupted or error-free operation. Server locations, speeds, protocols, and features may change. The Service is not a substitute for security practices appropriate to high-risk situations.
7. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains what we collect and how we handle it. We do not log your browsing activity.
8. Intellectual property
The Service, including its software, design, logos, and content, is owned by Iran IP VPN or its licensors and is protected by law. We grant you a limited, personal, non-transferable, revocable licence to use the App on your devices for its intended purpose. The App incorporates open-source components, which remain under their respective licences.
9. Disclaimers & limitation of liability
To the maximum extent permitted by law, the Service is provided without warranties of any kind, and we are not liable for indirect, incidental, or consequential damages, or for loss of data, profits, or goodwill, arising from your use of (or inability to use) the Service. Nothing in these Terms limits liability that cannot be limited by law.
10. Indemnification
To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless A and S Lomond (trading as Iran IP VPN) and its owners, employees, and partners from and against any claims, demands, losses, liabilities, damages, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your breach of these Terms, or your violation of any law or the rights of any third party, including any breach of the eligibility, sanctions, or export-control representations in Section 1.
11. Governing law & dispute resolution
These Terms are governed by the laws of England and Wales, without regard to its conflict-of-laws rules. Subject to any mandatory consumer-protection laws of your country of residence, the courts of England and Wales shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to that jurisdiction and venue. You agree to first contact us to seek a good-faith resolution before starting formal proceedings.
12. General terms
- Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service and supersede any prior understanding.
- Severability. If any provision is held invalid or unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force.
- No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment. You may not assign or transfer these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, reorganization, or sale of assets.
- Force majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, for material changes, provide more prominent notice. Your continued use of the Service after an update means you accept the revised Terms.
